What is Mediation?

Mediation is a voluntary, confidential form of alternative dispute resolution.  It is often used by those who want to avoid court for formal litigation.

How does Mediation Work?

Mediation is facilitated by a Mediator, a neutral third party, who will guide the discussion and ask questions to identify the issues. Once the issues are identified the parties collaborate in brainstorming ways to resolve those issues.

Is Mediation Worth my Time?

YES! Mediated agreements are complied with at a rate of 80% – 90%. People are more likely to comply with agreements that they help to create themselves.

Is Virtual Mediation an Option?

Yes. All cases with Nixson Mediation Services are held virtually unless arranged otherwise.

What happens after Mediation?

Once mediation is complete, your mediator can draft an agreement or memorandum of agreements based on the agreements made during your sessions. Mediators are not acting as attorneys or judges; it is highly recommended that you have any document reviewed by an attorney before signing and/or filing with the court.

Can I bring my Attorney?

Yes!  If you have representation, they may attend if all parties agree.  If the other party does not agree, the Mediator may set up a separate breakout room in the remote video call so that you can speak with your attorney when needed during the mediation.
